2. Response to DMCA Takedown Notices
Upon receiving a valid DMCA Takedown Notice, we will:
- Remove or disable access to the allegedly infringing material.
- Notify the user responsible for the content about the takedown.
- Provide the user with information on how to file a counter-notification if they believe the material was removed in error.
3. Filing a DMCA Counter-Notification
If you believe that the material removed or disabled by a DMCA Takedown Notice was done so in error, you may file a DMCA Counter-Notification.
To submit a Counter-Notification, please provide the following information:
- Identification of the material that has been removed or disabled, including the specific URL(s) where it appeared before it was removed.
- Your contact information, including your full name, mailing address, phone number, and email address.
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or if outside the United States, the jurisdiction of any judicial district where Smachar News may be found) and that you will accept service of process from the party that filed the original DMCA Takedown Notice.

4. Repeat Infringers
Smachar News reserves the right to terminate the accounts or block access to users who repeatedly infringe on others’ intellectual property rights, at our sole discretion.
5. Good Faith and Misrepresentation
Please note that any false claims or misrepresentations in your DMCA notice or counter-notice may result in liability for damages, including legal fees. We encourage all parties to ensure they have a legitimate claim before submitting any notice under the DMCA.
